Viewpoints on the Companies Act

This survey was conducted in June 2024. The survey sought feedback around proposed changes to the Companies Act, gathering feedback on current safety and confidentiality concerns.

Key findings:

  • 30 per cent have had a safety concern regarding the public availability of their personal residential address.
  • 49 per cent said the requirement to pay a fee would be a disincentive to applying to unpublish a residential address from the companies register.
  • 28 per cent said the requirement to complete a statutory declaration would be a disincentive to applying to unpublish a residential address from the companies register.

MEMBER FEEDBACK:

“I am always concerned that the residential address is published publicly on the government website. I also have concern about the food registration certificate which is compulsory to display for the customers as it also has our residential address displayed. I strongly believe that should be neither published nor displayed as it is concern of the privacy.”

“I don’t think that the option of having your home address kept private should just be made available to people who have specific concerns for their safety – I think this option should be available to everyone.”

“I feel the requirement to publicly list director home addresses is a gross infringement of privacy and potential safety of the individuals concerned.”
